Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Found3r ("Found3r", "we", "us") governing your access to and use of found3r.dev and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for all activity that occurs under your account. Tell us at support@found3r.dev promptly if you suspect unauthorised access.

2. The Service

Found3r provides software tools that help founders research, validate, and build products, including automated research agents, generated landing pages, and related analytics. The Service is provided on a software-as-a-service basis and evolves over time; we may add, change, or remove features.

Outputs produced by our automated and AI-assisted features are informational. They may contain errors and are not business, legal, financial, or investment advice. You are responsible for independently verifying any output before relying on it.

3. Subscriptions, billing, and taxes

  • Paid plans are billed in advance on a recurring monthly or annual cycle, in US dollars, at the price shown at the time you subscribe.
  • By subscribing, you authorise us and our payment processor to charge your payment method automatically at the start of each billing period until you cancel.
  • Prices exclude taxes unless stated otherwise. You are responsible for any applicable sales, use, VAT, or GST amounts, which may be added at checkout.
  • We may change plan pricing. Changes apply from your next billing period, and we will give you at least 30 days' notice by email before they take effect.
  • If a payment fails, we may retry it and may suspend access to paid features until payment succeeds.

Cancellations and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms.

4. Acceptable use

You agree not to, and not to permit anyone else to:

  • Use the Service to break the law or infringe anyone's rights, including intellectual property and privacy rights.
  • Upload malware, attempt to gain unauthorised access to the Service, or interfere with its integrity, security, or availability.
  • Reverse engineer, scrape, or resell the Service except to the extent that restriction is prohibited by law.
  • Use the Service to generate spam, harassment, deceptive content, or content that impersonates another person or organisation.
  • Circumvent usage limits, rate limits, or access controls associated with your plan.

We may suspend or terminate accounts that violate this section, in serious cases without prior notice.

5. Your content

You retain ownership of the ideas, text, and other material you submit to the Service ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, and transmit Your Content solely to operate, secure, and improve the Service and to provide it back to you.

You are responsible for Your Content and for having the rights necessary to submit it. Subject to these Terms and your plan, you own the outputs the Service generates for you from Your Content.

6. Our intellectual property

The Service, including its software, models, interfaces, branding, and documentation, is owned by Found3r and its licensors and is protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with your plan. No other rights are granted.

7. Third-party services

The Service integrates third-party providers for authentication, hosting, data infrastructure, AI model inference, and payment processing. Your use of the Service may be subject to those providers’ terms. We are not responsible for third-party services we do not control.

8. Termination

You may stop using the Service and cancel your subscription at any time from your account settings. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service.

On termination, your right to use the Service ends immediately. We may delete your data after a reasonable retention period; export anything you need before cancelling.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any result or business outcome will be achieved.

10. Limitation of liability

To the maximum extent permitted by law, Found3r will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising out of or relating to the Service.

Our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred US dollars.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Indemnity

You agree to indemnify and hold harmless Found3r and its officers, employees, and agents from any claims, damages, liabilities, and reasonable legal fees arising from Your Content, your use of the Service, or your breach of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before they take effect. Continuing to use the Service after changes take effect means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The courts located in that jurisdiction will have exclusive jurisdiction over any dispute arising out of these Terms, except that either party may seek injunctive relief in any competent court.
